Terms of use

The terms of use (henceforth in the text – regulations) of the Financecounter.com Vortal (henceforth in the text – Vortal) are binding to all site users, regardless whether the visitor is a registered user of the Vortal or not.

1. The Vortal is maintained and administrated by Financecounter Limited (henceforth in the text – Financecounter.com).

2. The Vortal is intended for a narrow circle of society. Information posted on the Vortal is topical in business, economics, finance, energy and technology. The Vortal is available at financecounter.com as well as in mobile applications (for instance – smartphones, tablets etc.).

3. The user is obliged to get familiarized with the terms of use as and to comply with them before using the vortal. Financecounter.com has the right to amend and edit the regulations at any time. Such changes take effect after being published to Vortal.

4. It is considered that the user has familiarized himself with the terms of use and follows the regulations in power at the time of use by using the Vortal. Each user has an obligation to regularly revisit the regulations page in order to keep up oneself updated with any changes been made. If the user does not agree with the regulations, then the user is forbidden to use the Vortal.

5. Registered users of the Vortal have the rights to use the resources and services offered by the Vortal.

6. In order to become a registered user of the Vortal, the user must complete the registration procedure established by the Vortal.

7. Any registered user must take into account that the data provided (name, surname and other information) on the user’s profile must be true. Each user registered in the Vortal is allowed to own a single profile. Each registered user is required not to disclose their Vortal access data to other parties. If actions in the Vortal are made by a registered user’s profile, using a correct username and password, it is considered that the actions made in the profile are made by the registered individual.

8. Any commercial activities in the Vortal are forbidden, with the exception of a relevant section of the regulations or with a written consent from Financecounter.com

9. The Vortal’s administration has the rights to delete any registered Vortal user’s profile and/or any information without previous notice, such as, video, pictures, audio materials and other information in it, as well as to limit or deny access to the Vortal temporarily or permanently (including specific IP addresses), without explaining the reasons.

10. Each Vortal’s user holds full responsibility for any information that it publishes (including photo, video and audio materials) as well as is accountable for the consequences of placing this information. The user has the right to place in the Vortal only such information, to which the user has full and unlimited rights.

11. It is prohibited to publish such information in the Vortal that violates or infringes the third party rights or intellectual property. List of the nature of such information goes as follows;

    • Adversely affects the person’s honour and dignity;
    • Calls for violence or other unlawful acts or omissions;
    • Is aimed at causing hatred or inferiority depending on the person’s national, ethnic, racial, religious affiliation or gender, age, disability or any other characteristics;
    • Is vulgar, abusive or in offensive in any other way;
    • Contains computer viruses or is designed to harm the computer or safe function of the electronic communications software;
    • Unsolicited advertising, is of pornographic or overly erotic nature, or video chat promoted or a job at a video chat is offered;
    • All other information that affects or is likely to affect Vortal’s operations and safety;
    • Advertising of financial services that are not licensed in accordance with the regulatory enactments for the provision of financial services in the Republic of Latvia;
    • Advertising or promotion of unauthorized competition, pyramid profit schemes, sales methodology based on the sales recruitment;
    • Violates regulations, is false, discriminatory, abusive or unlawful.
  1. Financecounter.com is not responsible for the availability of the Vortal, interconnection of the Vortal users, any technical functionality issues of the Vortal, Vortal user’s profile data changes and activities in the profile as a result of someone else’s authorized or unauthorized access. All operations of the Vortal are offered as they are, with no additional guarantees from Financecounter.com. Furthermore, Financecounter.com takes no responsibility for any type of losses that are caused or could be caused to user’s as a result of Vortal use or any of its offered services.
  2. The user of the Vortal is obliged to do everything necessary to secure the legal interests of Financecounter.com, including compensating losses to all third-party requirements or claims that are brought or could be brought against Financecounter.com, and are in any way related or caused by users’ actions or inactivity in the Vortal.
  3. If the access to the Vortal is denied or restricted the individual’s profile, or information in the profile is deleted, no losses or payments in connection with the paid services in the Vortal are paid back to the Vortal’s user.
  4. The Vortal user agrees to receive information from Financecounter.com about various types of Vortal related news.
  5. All intellectual property rights relating to the Vortal are owned exclusively by Financecounter.com. In case of infringement of these rights, the guilty person will be called to liability specified in the regulatory enactments as well as will be fully responsible for all losses that are or could be dealt to the Financecounter.com and third parties.
  6. All disputes between Financecounter.com and the Vortal users are negotiated. If the disputes fail to resolve by form of negotiation, then they are settled by the court of Republic of Latvia in accordance with the rules and regulations of the Republic of Latvia.

Privacy

1. All Personal Data and Personal Identification Codes of the user placed on the Vortal are protected in accordance with the regulation Nr. 2016/679 of the European Parliament and Council.

2. When registering on the Vortal and/or using the Vortal, the user expresses consent that Financecounter.com processes the concerned user’s personal data and personal identification code in accordance with the personal data protection law.

3. Financecounter Limited is the manager of processing personal data and user identification codes. Financecounter  is registered at Barona Business Centre, Office 40, 214 Krisjana Barona Street, Jelgava, LV-3008, Latvia.

4. The Purpose of processing user data and personal identification codes – provision of user communication services, publishing various content of the users. Provision of information services to users, adjustment and selection of the advertisements.

5. A registered user of the Vortal is informed and consents that the data provided (for example – name and surname, place of residence, profile picture etc.) in the concerned user’s profile is publicly accessible to all of the registered users of the Vortal as well as to third parties in a limited amount, and that the processing of this public data does not depend on Financecounter.com. Only data inserted by the user himself is saved in a registered user’s profile.

6. Registered users have the rights to add, edit or delete the data, content and information provided in their profile as well as to delete their whole profile by themselves. If a registered user’s profile is deleted, then a part of the information published by the user is not deleted because it is not linked to the user’s profile (for example, comments and blogs below the articles published in the portal). After the deletion of the profile, data and/or information of the profile, it will be instantly inaccessible to other users but the mentioned profile, data and/or information may be saved for up to 50 days in the databases of Financecounter.com.

7. The user is informed and consents that the advertisements of third parties may be posted to the Vortal and also sent to the user. Financecounter.com never gives up information of the Vortal users and their personal data to the advertiser, although, the advertiser may have rights to define the audience of the advertisement (for example, by the user’s gender, age, location, contact information etc.).

8. Financecounter.com receives and stores information from the user’s web browser (including IP address, cookies) and device information (for example, model of the device, operating system, settings, network operator, location etc.).

9. Financecounter.com has the right to collect and publish information about the community of users without identifying specific users and disclosing personal data (for example, research, data analysis, information on advertising returns etc.).

10. When registering and/or using the Vortal, the user consents that he is informed and agrees that Financecounter.com has the rights to give up the user’s personal data in the following cases:

    • To other parties if Financecounter.com receives the user’s consent;
    • To law enforcement agencies if Financecounter.com receives a demand from the Republic of Latvia in accordance with the procedures specified in regulatory enactments;
    • To law enforcement agencies if Financecounter.com recognizes that the concerned user’s actions violates these regulations and/or regulations of the Republic of Latvia and that it results or may result in affecting interests of Financecounter.com, Vortal users or other persons.

What personal data we collect and why we collect it

Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address, the browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Website visitors can download and extract any location data from images on the website.

Cookies

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

Analytics

We use Google Analytics to monitor traffic to this site, and to monitor traffic from subscription emails sent via MailChimp. Google Analytics collects information that includes your IP address, browser type and pages visited on this site, by placing a tracking cookie in your web browser. It does not collect names, emails or any physical addresses. This data is used solely for the purposes of monitoring traffic to Financecounter.com. All data is kept for 24 months before being automatically deleted.

Who we share your data with

Other than the Google Analytics properties mentioned above, we do not share your data with any third parties, including social media platforms such as Facebook, Twitter or Instagram.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What rights you have over your data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.
